margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n1. <i>Necesitatea unei jurisdic\u0163ii penale interna\u0163ionale. <\/i>Dreptul  penal interna\u0163ional a cunoscut p\u00e2n\u0103 \u00een prezent progrese remarcabile \u00een  plan material, prin adoptarea unor importante conven\u0163ii interna\u0163ionale  de reglementare a colabor\u0103rii \u00een diverse domenii, care cuprind \u015fi  dispozi\u0163ii cu caracter penal pentru sanc\u0163ionarea \u00eenc\u0103lc\u0103rilor grave ale  prevederilor acestora, sau prin \u00eencheierea unor conven\u0163ii cu caracter  pur penal de incriminare \u015fi sanc\u0163ionare a unor fapte grave ce aduc  atingere unor valori universale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  plan jurisdic\u0163ional, al cre\u0103rii unor institu\u0163ii judiciare  interna\u0163ionale, care s\u0103 pun\u0103 \u00een aplicare normele de drept material  consacrate, realiz\u0103rile sunt, \u00eens\u0103, mai pu\u0163ine.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;\u00cen lipsa unei asemenea jurisdic\u0163ii penale, sanc\u0163ionarea infrac\u0163iunilor interna\u0163ionale&nbsp; continu\u0103  s\u0103 fie realizat\u0103, cu unele excep\u0163ii limitate \u015fi conjuncturale, \u00een cadru  na\u0163ional, de c\u0103tre instan\u0163ele penale ale fiec\u0103rui stat.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conven\u0163iile  interna\u0163ionale prin care se incrimineaz\u0103 anumite fapte penale cuprind  prevederi potrivit c\u0103rora statele membre se angajeaz\u0103 s\u0103 caute pe  autorii respectivelor infrac\u0163iuni \u015fi s\u0103-i pedepseasc\u0103 indiferent de  cet\u0103\u0163enia acestora ori a victimelor lor, de locul unde au fost comise  faptele , sau, \u00een cazul \u00een care nu consider\u0103 necesar sau posibil s\u0103 o  fac\u0103, s\u0103-i extr\u0103deze altui stat interesat, precum \u015fi s\u0103 coopereze \u00eentre  ele, astfel ca ace\u015ftia s\u0103 nu r\u0103m\u00e2n\u0103 nepedepsi\u0163i, ele exercit\u00e2nd \u00een acest  mod, o competen\u0163\u0103 universal\u0103 cu caracter alternativ.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conven\u0163iile  interna\u0163ionale respective nu stabilesc, \u00eens\u0103, \u015fi reguli de drept  judiciar sau procedural, \u00een afara unor dispozi\u0163ii destul de sumare  referitoare la obliga\u0163ia respect\u0103rii de c\u0103tre instan\u0163ele judec\u0103tore\u015fti  na\u0163ionale a garan\u0163iilor procesuale general recunoscute \u015fi comune  legisla\u0163iei penale&nbsp; a statelor civilizate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen baza conven\u0163iilor interna\u0163ionale care asigur\u0103 protec\u0163ia&nbsp; umanitar\u0103  a victimelor conflictelor armate, statele p\u0103r\u0163i s-au angajat s\u0103 ia  toate m\u0103surile legislative sau de alt\u0103 natur\u0103, necesare pentru  reprimarea infrac\u0163iunilor grave, cu caracter de crime interna\u0163ionale,  definite \u00een cuprinsul acestora.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Astfel,  Conven\u0163iile de la Geneva din 1949 (art. 49 al Conven\u0163iei I, art. 50 al  Conven\u0163iei a II-a, art. 105-108 \u015fi 129 ale Conven\u0163iei a III-a \u015fi art.  146 al Conven\u0163iei a IV-a), Protocolul I adi\u0163ional la aceste conven\u0163ii ,  \u00eencheiat \u00een 1977 (art. 85, par. 1), ca \u015fi Conven\u0163ia de la Geneva din  1954 pentru protec\u0163ia bunurilor culturale \u00een caz de conflict armat (art.  28) impunstatelor semnatare, \u00eentre altele, trei categorii de obliga\u0163ii:  de a incrimina \u00een legisla\u0163ia na\u0163ional\u0103 faptele grave de \u00eenc\u0103lcare a  regulilor umanitare, de a sanc\u0163iona persoanele care comit infrac\u0163iuni de  aceast\u0103 natur\u0103 \u015fi de a asigura anumite garan\u0163ii de ordin procedural  pentru inculpa\u0163i referitoare la judecat\u0103, dreptul la ap\u0103rare, c\u0103ile de  recurs sau executarea pedepselor.<\/div>\n<p><a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\"><\/a><\/p>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Asemenea  obliga\u0163ii sunt asumate de c\u0103tre statele p\u0103r\u0163i \u015fi \u00een cuprinsul  conven\u0163iilor referitoare la reprimarea altor infrac\u0163iuni interna\u0163ionale,  cum ar fi genocidul (art. V al Conven\u0163iei din 1948), terorismul (art. 1  al Conventiei din 1937), traficul de stupefiante (art. 36 al Conven\u0163iei  unice asupra stupefiantelor din 1961) etc.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sanc\u0163ionarea  potrivit jurisdic\u0163iilor na\u0163ionale a infrac\u0163iunilor incriminate prin  conven\u0163ii interna\u0163ionale constituie o modalitate juridic\u0103 necesar\u0103, dar  nu suficient\u0103. Practica a dovedit&nbsp; c\u0103 lipsa unei  jurisdic\u0163ii interna\u0163ionale permanent\u0103 \u015fi impar\u0163ial\u0103, competent\u0103 s\u0103  judece toate infrac\u0163iunile cu caracter interna\u0163ional, astfel cum acestea  sunt definite \u015fi caracterizate prin conven\u0163iile respective, constituie o  lacun\u0103 major\u0103 a dreptului interna\u0163ional actual, cu consecin\u0163e  defavorabile pentru comunitatea interna\u0163ional\u0103 \u00een efortul tot mai  organizat al acesteia de a controla fenomenul infrac\u0163ional \u015fi de a  sanc\u0163iona pe cei ce \u00eencalc\u0103 legalitatea interna\u0163ional\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dac\u0103  \u00een cazul infrac\u0163iunile s\u0103v\u00e2r\u015fite de c\u0103tre persoane particulare acest  inconvenient este \u00een mare m\u0103sur\u0103 limitat prin formele de colaborare  interna\u0163ional\u0103 institu\u0163ionalizate \u00een cuprinsul conven\u0163iilor (asisten\u0163a  judiciar\u0103, extr\u0103darea, comisiile rogatorii, cooperarea \u00een prinderea  infractorilor etc.), \u00een cazul celorlalte crime (contra p\u0103cii, \u00eempotriva  umanit\u0103\u0163ii \u015fi de r\u0103zboi), care constituie cele mai grave \u00eenc\u0103lc\u0103ri ale  dreptului interna\u0163ional, posibilitatea ca faptele s\u0103 fie pedepsite de  c\u0103tre tribunalele na\u0163ionale este redus\u0103, dac\u0103 nu iluzorie, deoarece  asemenea infrac\u0163iuni sunt cel mai adesea inspirate sau ordonate de c\u0103tre  guvernele statelor.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ideea  cre\u0103rii unui tribunal penal interna\u0163ional care s\u0103 fie competent a  judeca infrac\u0163iunile comise prin \u00eenc\u0103lcare normelor de drept  interna\u0163ional dateaz\u0103 \u00eenc\u0103 din secolul al XIX-lea, iar tentativele de  materializare au \u00eenceput a se face dup\u0103 primul r\u0103zboi mondial, \u00een cadrul  Societ\u0103\u0163ii Na\u0163iunilor, sus\u0163inute fiind \u015fi de \u00eenalte foruri ale \u015ftiin\u0163ei  juridice, \u00een special de Asocia\u0163ia de Drept Interna\u0163ional, Institutul de  Drept Interna\u0163ional \u015fi Asocia\u0163ia Interna\u0163ional\u0103 de Drept Penal, o  contribu\u0163ie important\u0103 av\u00e2nd \u00een cadrul acestora rom\u00e2nul Vespasian V.  Pella, \u015fi au fost continuate apoi \u00een cadrul Organiza\u0163iei Na\u0163iunilor  Unite, \u00eencep\u00e2nd cu anul 1950.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conven\u0163ii  interna\u0163ionale importante privind incriminarea unor fapte grave cum  sunt cele referitoare la terorism (1937), genocid (1948) \u015fi apartheid  (1973), prevedeau c\u0103 judecarea faptelor de acest gen s\u0103 se fac\u0103 nu numai  de c\u0103tre instan\u0163ele na\u0163ionale, ci \u015fi de c\u0103tre o curte sau un tribunal  penal interna\u0163ional, dar proiectele \u00eentocmite nu au putut s\u0103 fie  finalizate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  lipsa unui tribunal interna\u0163ional cu competen\u0163\u0103 universal\u0103, unele nevoi  presante \u015fi punctuale au fost satisf\u0103cute prin \u00eenfiin\u0163area de tribunale  penale ad-hoc.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  1945 s-au constituit tribunalele militare interna\u0163ionale de la  N\u00fcrenberg \u015fi Tokio, care au judecat pe principalii vinova\u0163i de  declan\u015farea \u015fi purtarea celui de-al doilea r\u0103zboi mondial, iar mai  t\u00e2rziu s-au \u00eenfiin\u0163at Tribunalul Interna\u0163ional pentru fosta Iugoslavie  \u015fi cel pentru Ruanda, ast\u0103zi \u00een func\u0163iune.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tribunalul  Interna\u0163ional pentru fosta Iugoslavie a fost infiin\u0163at \u00een 1993 pentru  pedepsirea persoanelor responsabile de viol\u0103ri grave ale dreptului  umanitar, comise pe teritoriul acestei \u0163\u0103ri, \u00eencep\u00e2nd cu 1 ianuarie  1991, iar Tribunalul Interna\u0163ional pentru Ruanda a fost \u00eenfiin\u0163at \u00een  1994, av\u00e2nd drept sarcin\u0103 pedepsirea persoanelor responsabile de genocid  \u015fi alte viol\u0103ri grave ale dreptului interna\u0163ional umanitar comise pe  teritoriul Ruandei \u015fi a cet\u0103\u0163enilor ruandezi vinova\u0163i de genocid \u015fi alte  asemenea viol\u0103ri comise pe teritoriile statelor vecine, \u00eentre 1  ianuarie 1994 \u015fi 31 decembrie 1994. Ambele tribunale interna\u0163ionale au  fost constituite \u00een baza unor rezolu\u0163ii ale Consiliului de Securitate al  O.N.U.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2. <i>Curtea penal\u0103 interna\u0163ional\u0103<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<i>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp; Retrospectiv\u0103 \u015fi viitor<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<i>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/i><b>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/b><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<b>&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/b>Secolul XXI e marcat puternic \u00een anul s\u0103u de debut de apocalipticul 11 septembrie 2001.<\/div>\n<div class=\"MsoBodyTextIndent\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify;\">\nAtunci,  \u00een acea zi at\u00e2t de dramatic\u0103 \u015fi de crucial\u0103 a istoriei contemporane  Statele Unite ale Americii, simbolul democra\u0163iei siguran\u0163ei \u015fi  civiliza\u0163iei umanit\u0103\u0163ii s-au cl\u0103tinat, dar nu s-au pr\u0103bu\u015fit. <\/div>\n<div class=\"MsoBodyTextIndent\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify;\">\nTerorismul,  acest flagel ce parc\u0103 ast\u0103zi \u201cst\u0103p\u00e2ne\u015fte\u201d omenirea, a lovit nea\u015fteptat  America \u015fi prin ea, \u00eentreaga lume civilizat\u0103, cu o for\u0163\u0103 \u015fi o cruzime  cutremur\u0103toare. Pentru astfel de crime colective, odioase \u015fi barbare,  terori\u015ftii trebuie s\u0103 r\u0103spund\u0103 \u00een fa\u0163a justi\u0163iei. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nCum  \u00eentr-o \u0163ar\u0103 sunt s\u0103v\u00e2r\u015fite actele teroriste, iar \u00eentr-o alt\u0103 \u0163ar\u0103 se  exercit\u0103 comanda acestor acte, la care se adaug\u0103 \u015fi faptul c\u0103 o alt\u0103  \u0163ar\u0103 \u00eei finan\u0163eaz\u0103 pe terori\u015fti \u015fi \u00eentr-o alt\u0103 \u0163ar\u0103 se refugiaz\u0103  terori\u015ftii, o justi\u0163ie intern\u0103 \u00een fa\u0163a acestor cazuri este  neputincioas\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nNumai  o justi\u0163ie interna\u0163ional\u0103 penal\u0103 poate fi instrumentul juridic de  reprimare \u015fi pedepsire a acestor acte \u015fi atacuri teroriste. Iat\u0103, poate,  argumentul \u201cforte\u201d ce va c\u0103l\u0103uzi viitorul justi\u0163iei penale  interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nDar  pentru a \u00eentrez\u0103ri \u015fi a circumscrie traiectoriile generale ale acestui  viitor e absolut necesar s\u0103 arunc\u0103m, cel pu\u0163in o privire sumar\u0103 spre  trecut. Privirea retrospectiv\u0103 va fi structurat\u0103 \u00een esen\u0163\u0103 pe trei  perioade \u015fi anume:<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nA. Justi\u0163ia interna\u0163ional\u0103 penal\u0103 pan\u0103 la finele celui de-al doilea r\u0103zboi mondial; <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nB. De la N\u00fcrnberg la Haga;<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nC. Curtea penal\u0103 interna\u0163ional\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nA.  \u00cen cadrul privirii retrospective viz\u00e2nd prima perioad\u0103 enun\u0163at\u0103 \u015fi  anume p\u00e2n\u0103 la finele celui de-al doilea r\u0103zboi mondial vor fi avute \u00een  vedere \u00een principal trei planuri:<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 1.Proiecte de creare a unor instan\u0163e interna\u0163ionale penale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2.Realit\u0103\u0163i.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3.Idei de esen\u0163\u0103 subsumate acestor proiecte \u015fi realit\u0103\u0163i.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nAnalizand aceste planuri eviden\u0163iem urm\u0103toarele:<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n1. \u00cen leg\u0103tur\u0103 cu proiectele de creare a unor instan\u0163e interna\u0163ionale penale:<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Primul  proiect a apar\u0163inut juristului elve\u0163ian Gustav Moynier care a conceput  \u00een anul 1872 organizarea unei \u201cJurisdic\u0163ii criminale interna\u0163ionale\u201d.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Conven\u0163ia  de la Haga, din 1907 este un prim act de rezonan\u0163\u0103 interna\u0163ional\u0103 prin  care s-a \u00eencercat instituirea unei Cur\u0163i interna\u0163ionale de prize  maritime.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Tratatul  de la Versailles \u00eencheiat la finele primului r\u0103zboi mondial \u00een 1919  este tratatul care prevedea \u00een articolul 227 constituirea unui tribunal  special pentru a judeca pe Wilhelm al II-lea de Hohenzolern, \u00eemp\u0103ratul  Germaniei \u00eenvins\u0103 \u00een r\u0103zboi dar \u00eemp\u0103ratul n-a fost judecat pentru c\u0103  Olanda \u2013 unde se refugiase \u2013 nu l-a extr\u0103dat.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>\u00cen  anul 1920 \u00een cadrul Societ\u0103\u0163ii Na\u0163iunilor se propunea \u00eentocmirea unui  proiect de organizare a unei \u00cenalte Cur\u0163i de Justi\u0163ie Interna\u0163ional\u0103  separat\u0103 de Curtea Permanent\u0103 de Justi\u0163ie Interna\u0163ional\u0103. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; <\/span><\/span>\u00cen  anul 1928 reputatul jurist roman Vespasian Pella ca pre\u015fedinte al  Asocia\u0163iei interna\u0163ionale de drept penal \u00eentocmea un proiect de Statut  ce prevedea crearea unei Camere criminale \u00een sanul Cur\u0163ii Permanente de  Justi\u0163ie Interna\u0163ional\u0103. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>\u00cen anul 1935 Vespasian Pella \u00eentocmea \u015fi planul unui cod represiv mondial ce includea \u015fi proiectul de Statut din anul 1928.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; margin-left: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>La  16 noiembrie 1937 o dat\u0103 cu Conven\u0163ia asupra prevenirii \u015fi reprim\u0103rii  terorismului a fost adoptat\u0103 \u201cConven\u0163ia pentru crearea unei Cur\u0163i penale  interna\u0163ionale\u201d, ca o reac\u0163ie a actului de terorism interna\u0163ional ce a  afectat \u015fi a zguduit comunitatea interna\u0163ional\u0103 \u015fi anume atentatul de la  Marsilia \u00een care a fost ucis regele Alexandru al Iugoslaviei \u015fi  ministrul de externe al Fran\u0163ei Louis Barthou. De\u015fi semnat\u0103 de 24 de  state, Conven\u0163ia pentru crearea unei Cur\u0163i penale interna\u0163ionale n-a  intrat \u00een vigoare, procedurile de ratificare fiind \u00eempiedicate de  declan\u015farea celui de-al doilea r\u0103zboi mondial. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n2. Cu referire la realit\u0103\u0163i, mai exact, la \u00eenfiin\u0163area efectiv\u0103 a instan\u0163elor interna\u0163ionale penale:<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;Proiectele  de realizare a unor instan\u0163e interna\u0163ionale penale au devenit realitate  la finele celui de-al doilea r\u0103zboi mondial. Au fost instituite \u00een 1945  pentru a judeca pe responsabilii celei mai mari conflagra\u0163ii din  istoria omenirii: <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Tribunalul  militar interna\u0163ional de la Nurnberg creat de puterile victorioase \u00een  urma \u201cAcordului privind urm\u0103rirea \u015fi pedepsirea marilor criminali de  r\u0103zboi ai Puterilor europene ale Axei\u201d din 8 august 1945 care s\u0103 judece  pe criminalii de r\u0103zboi nazi\u015fti ale c\u0103ror crime erau f\u0103r\u0103 localizare  geografic\u0103 precis\u0103. Acest tribunal a condamnat la moarte 12 persoane, la  munc\u0103 silnic\u0103 pe via\u0163\u0103 3 persoane, la \u00eenchisoare \u00eentre 10 \u015fi 20 de ani 4  persoane, iar \u00een privin\u0163a a 3 inculpa\u0163i s-a dispus achitarea. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>Tribunalul  interna\u0163ional penal Tokio creat \u00een condi\u0163ii istorice asem\u0103n\u0103toare cu  cele ale Tribunalului de la Nurnberg ce a fost convenit \u00een cuprinsul  \u201cDeclara\u0163iei de la Postdam\u201d din 26 iulie 1945 semnate de S.U.A., Marea  Britanie \u015fi China, acest tribunal fiind cadrul juridic necesar pentru a  pedepsi pe militan\u0163ii japonezi r\u0103punz\u0103tori de crimele comise \u00een Extremul  Orient. A condamnat la moarte 7 persoane, la \u00eenchisoare pe via\u0163\u0103 11  persoane iar la deten\u0163ie pe via\u0163\u0103 7 persoane.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n3.  \u00cen ceea ce prive\u015fte ideile de esen\u0163\u0103 subsumate acestor proiecte \u015fi  realit\u0103\u0163i privind fiin\u0163area de instan\u0163e interna\u0163ionale penale: <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Proiectele  precum \u015fi func\u0163ionarea efectiv\u0103 a celor dou\u0103 instan\u0163e penale  interna\u0163ionale de la finele celui de-al doilea r\u0103zboi mondial vizau  numai crimele interna\u0163ionale, crimele cele mai grave a c\u0103ror distinc\u0163ie  \u015fi specificitate era dat\u0103 de lezarea valorilor supreme ale comunit\u0103\u0163ii  interna\u0163ionale \u2013 pacea \u015fi securitatea \u2013 \u015fi nu de vreun element de  extraneitate al vreunei crime ce ar apar\u0163ine unui drept na\u0163ional. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Din  punct de vedere al competen\u0163ei \u201cratione materiae\u201d, astfel de crime ce  afectau grav pacea \u015fi securitatea interna\u0163ional\u0103, ce puteau fi judecate  de instan\u0163ele interna\u0163ionale penale propuse sau create erau \u00eentr-un plan  mai general: crimele de r\u0103zboi, crimele contra p\u0103cii \u2013 \u00een special  agresiunea \u2013 sau crimele contra umanit\u0103\u0163ii, dintre care se poate deta\u015fa  nu numai ca rezonan\u0163\u0103 dar \u015fi ca actualitate genocidul \u015fi terorismul. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Privit  prim prisma competen\u0163ei \u201cratione personae\u201d era vizat\u0103 responsabilitatea  penal\u0103 individual\u0103 \u2013 departe de orice protec\u0163ie a actului de stat sau a  ordinului ierarhic \u2013 \u00een principiu a elitei puterii, a guvernan\u0163ilor  afla\u0163i la putere sau a responsabililor afla\u0163i \u00een etajele imediate ale  ierarhiei puterii, care trebuiau s\u0103 con\u015ftientizeze c\u0103 este sau urma s\u0103  fie o lege \u015fi pentru ei, \u015fi mai presus de ei, care s\u0103 antreneze o atare  r\u0103spundere penal\u0103. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>De\u015fi  s-a militat \u00een toate proiectele pentru instituirea unei instan\u0163e  interna\u0163ionale permanente, \u00een realitate, astfel de instan\u0163e cum au fost  tribunalele de la Nurnberg \u015fi Tokio au fost \u00eenfiin\u0163ate ad-hoc, \u00een urma  r\u0103zboiului ele avand numai un caracter temporar. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Fiind  o justi\u0163ie dictat\u0103 de \u00eenving\u0103tori \u00eenvin\u015filor, o atare justi\u0163ie purta  firesc cu ea tr\u0103s\u0103turi evidente de partizanat ce afectau profund esen\u0163a  actului de justi\u0163ie fie el intern sau interna\u0163ional care se define\u015fte \u00een  primul rand prin echidistan\u0163\u0103 \u015fi impar\u0163ialitate. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Pornind  de la aceast\u0103 idee se na\u015fte legitima \u00eentrebare: oare ru\u015fii n-au  s\u0103var\u015fit crime de r\u0103zboi sau crime \u00eempotriva umanit\u0103\u0163ii cand \u00een timpul  r\u0103zboiului au distrus ora\u015fe \u00eentregi precum Dresda sau Koln-ul sau  americanii atunci cand au aruncat cea mai cumplit\u0103 bomb\u0103,&nbsp; bomba  atomic\u0103 asupra a\u015fez\u0103rilor civile din ora\u015fele japoneze de cea mai trist\u0103  \u015fi dramatic\u0103 faim\u0103 Hiroshima \u015fi Nagasaki? Cine i-a judecat pe  \u00eenving\u0103torii din r\u0103zboi? R\u0103spunsul e atat de simplu \u015fi de scurt: nimeni!<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nB. De la Nurnberg la Haga.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nCum  o justi\u0163ie intena\u0163ional\u0103 penal\u0103 temporar\u0103 \u00ee\u015fi avea limitele sale \u2013 \u015fi  experien\u0163a tr\u0103it\u0103 la tribunalele interna\u0163ionale de la Nurnberg \u015fi Tokio o  demonstra cu prisosin\u0163\u0103 \u2013 comunitatea interna\u0163ional\u0103 dup\u0103 r\u0103zboi  devenea preocupat\u0103 din ce \u00een ce mai mult pentru instituirea unei  jurisdic\u0163ii interna\u0163ionale penale cu caracter permanent.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n\u00cen  acest sens Organiza\u0163ia Na\u0163iunilor Unite, cea mai reprezentativ\u0103  organiza\u0163ie mondial\u0103 \u00eenfiin\u0163at\u0103 imediat dup\u0103 finele celui de-al doilea  r\u0103zboi mondial a \u00eens\u0103rcinat organismul s\u0103u specializat, Comisia de drept  interna\u0163ional s\u0103 redacteze \u00een paralel dou\u0103 proiecte \u015fi anume: Proiectul  unei jurisdic\u0163ii criminale interna\u0163ionale \u015fi Proiectul unui cod al  crimelor contra p\u0103cii \u015fi securit\u0103\u0163ii umanit\u0103\u0163ii.&nbsp;&nbsp;&nbsp; <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nDe\u015fi  aceste proiecte au fost elaborate de aceast\u0103 Comisie \u00een anul 1953 \u015fi  1954 totu\u015fi abordarea lor a trecut tot timpul pe plan secundar pe agenda  O.N.U., dezbaterea lor fiinf amanat\u0103 \u201csine die\u201d. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nA  trebuit s\u0103 treac\u0103 aproape cincizeci de ani, s\u0103 vin\u0103 momentul istoric de  mare r\u0103scruce al anului 1989 cand, \u00een aceast\u0103 zon\u0103 atat de exploziv\u0103 a  Balcanilor a izbucnit sangerosul conflict din Iugoslavia. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nS-au  comis crime, s-au comis atrocit\u0103\u0163i de o parte \u015fi de alta \u015fi, din nou,  comunitatea interna\u0163ional\u0103 n-avea instrumentul judiciar penal  interna\u0163ional oportun \u015fi necesar prin care s\u0103 judece guvernan\u0163ii ce au  s\u0103var\u015fit sau ordonat astfel de crime ce au afectat grav pacea \u015fi  securitatea interna\u0163ional\u0103. Pentru crearea unui asemenea instrument  juridic, mai exact, pentrru crearea unei instan\u0163e interna\u0163ionale penale,  de aceast\u0103 dat\u0103, Organiza\u0163ia Na\u0163iunilor Unite a hot\u0103rat s\u0103 mearg\u0103 pe  dou\u0103 drumuri paralele: unul pentru \u00eenfiin\u0163area unei instan\u0163e  interna\u0163ionale penale permanente \u2013 prin rezolu\u0163ia num\u0103rul 4733 din 25  noiembrie 1992 a O.N.U. \u2013 iar altul pentru \u00eenfiin\u0163area unor instan\u0163e  interna\u0163ionale ad-hoc, temporare numai pentru conflictul din Iugoslavia.  <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nAceast\u0103  ultim\u0103 instan\u0163\u0103 intitulat\u0103 Tribunalul Interna\u0163ional Penal pentru fosta  Iugoslavie a fost \u00eenfiin\u0163at\u0103 de Consiliul de Securitate al O.N.U. care a  decis prin rezolu\u0163ia nr. 808 din 22 februarie 1993 \u015fi prin rezolu\u0163ia  nr. 827 din 25 mai 1993 \u201cstabilirea unui tribunal interna\u0163ional pentru  scopul unic de a pedepsi persoanele responsabile de viol\u0103ri grave ale  dreptului umanitar comise pe teritoriul fostei Iugoslavii \u00eentre 1  ianuarie 1991 \u015fi o dat\u0103 ce urmeaz\u0103 a fi stabilit\u0103 de Consiliul de  Securitate la restabilirea p\u0103cii\u201d a\u015fa cum rezult\u0103 expres din titlul  celei de-a doua rezolu\u0163ii a Consiliului de Securitate al O.N.U. enun\u0163at\u0103  mai sus. Sediul acestui tribunal s-a dispus a fi la Haga. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nTot  \u00een aceast\u0103 perioad\u0103 Consiliul de Securitate al O.N.U. prin rezolu\u0163ia  nr. 955 din 8 noiembrie 1994 a \u00eenfiin\u0163at o alt\u0103 instan\u0163\u0103 similar\u0103 cu  Tribunalul interna\u0163ional penal de la Haga pentru fosta Iugoslavie \u015fi  anume Tribunalul interna\u0163ional pentru Ruanda.&nbsp;&nbsp; <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00b7<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Critici privind legitimitatea Tribunalului interna\u0163ional penal pentru fosta Iugoslavie: <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Invocarea  \u00een crearea tribunalului a capitolului VII din Carta O.N.U. intitulat  \u201cAc\u0163iunea \u00een caz de amenin\u0163\u0103ri \u00eempotriva p\u0103cii, de \u00eenc\u0103lc\u0103ri ale p\u0103cii  \u015fi de acte de agresiune\u201d nu \u00eendrituie\u015fte prin prevederile articolelor  cuprinse \u00een acest capitol, nici cel pu\u0163in indirect, c\u0103 se impune  \u00eenfiin\u0163area de c\u0103tre Consiliul de Securitate al O.N.U. a unui organism  judiciar ca m\u0103sur\u0103 \u2013 care nu implic\u0103 folosirea for\u0163ei armate potrivit  art. 41 din Carta O.N.U. &#8211; necesar\u0103 pentru men\u0163inerea sau restabilirea  p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale.&nbsp;&nbsp;&nbsp;&nbsp; <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Un  alt temei invocat \u00een legitimitatea acestui tribunal a fost prevederea  art. 29 din Carta O.N.U. conform c\u0103ruia Consiliul de Securitate poate  \u00eenfiin\u0163a organele subsidiare pe care le consider\u0103 necesare pentru  \u00eendeplinirea func\u0163iilor sale. Dar acest temei nu poate subzista cel  pu\u0163in pentru urm\u0103toarele dou\u0103 considerente: <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>din  practica de peste o jum\u0103tate de secol a O.N.U. rezult\u0103 c\u0103 au fost  create numeroase \u015fi variate organe subsidiare \u2013 comitete, comisii,  misiuni etc. &#8211; dar printre acestea nu s-a g\u0103sit niciodat\u0103 instituirea  vreunei jurisdic\u0163ii. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>dac\u0103  e crea\u0163ia unui organism politic cum e Consiliul de Securitate atunci  \u00eenseamn\u0103 c\u0103 justi\u0163ia e dependent\u0103 exclusiv de organismul politic ce a  \u00eenfiin\u0163at-o s\u0103dind, \u00een consecin\u0163\u0103, ne\u00eencrederea statelor \u00eentr-o atare  justi\u0163ie.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Este  anormal, atipic pentru o jurisdic\u0163ie ca adoptarea \u015fi modificarea  regulilor de procedur\u0103 aplicabile tribunalului pentru fosta Iugoslavie  de la Haga s\u0103 fie atributul chiar al judec\u0103torilor ce compun aceast\u0103  instan\u0163\u0103. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\nSunt  pozi\u0163ii critice \u2013 mai pot fi invocate \u015fi altele \u2013 care confer\u0103 suport  atitudinii de contestare a legitimit\u0103\u0163ii acestui tribunal de principalul  responsabil de crimele \u015fi atrocit\u0103\u0163ile comise \u00een Iugoslavia, fostul  pre\u015fedinte Slobodan Milo\u015fevici, \u00een prezent inculpat la Tribunalul  Interna\u0163ional Penal de la Haga pentru fosta Iugoslavie. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Este \u015fi la Haga ca \u015fi la Nurnberg justi\u0163ia \u00eenvin\u015filor dictat\u0103 de \u00eenving\u0103tori? <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; M\u0103  \u00eentreb, de asemenea: organiza\u0163ia N.A.T.O. prin factorii ei responsabili  n-a s\u0103v\u00e2r\u015fit nici o crim\u0103 pentru a\u015fa-zisele pagube \u201ccolaterale\u201d soldate  cu numeroase victime din r\u00e2ndul civililor?<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dar,  dac\u0103 Slobodan Milo\u015fevici a fost deferit justi\u0163iei interna\u0163ionale penale  de chiar statul s\u0103u, atunci asumarea acestei justi\u0163ii de c\u0103tre  Iugoslavia \u00eenseamn\u0103 asumarea acestei justi\u0163ii \u015fi de c\u0103tre fostul lider  al Iugoslaviei.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sunt  multe limite ale acestui Tribunal pentru fosta Iugoslavie ca \u015fi cele  viz\u00e2nd Tribunalele de la Nurnberg \u015fi Tokio, toate fiind circumscrise de  altfel de limitele fire\u015fti ale unei justi\u0163ii temporare ad-hoc.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De aceea cel\u0103lat drum ales de O.N.U. pentru o justi\u0163ie permanent\u0103 e mult&nbsp; mai sigur, e mult mai bun. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ast\u0103zi  Curtea Penal\u0103 Interna\u0163ional\u0103 ca instan\u0163\u0103 interna\u0163ional\u0103 penal\u0103  permanent\u0103 a devenit realitate. \u00cen ce condi\u0163ii a fost creat\u0103, care este  viitorul ei confundat cu cel al justi\u0163iei penale interna\u0163ionale, iat\u0103  cateva \u00eentreb\u0103ri la care \u00eencerc\u0103m s\u0103 r\u0103spundem mai jos. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; C. Curtea penal\u0103 interna\u0163ional\u0103.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Curtea  penal\u0103 interna\u0163ional\u0103 a devenit realitate dup\u0103 anul de gra\u0163ie al  istoriei 1989, demersurile pentru crearea unei astfel de instan\u0163e  interna\u0163ionale penale permanente fiind \u00eencepute \u00een anul 1992 \u2013 cum se  ar\u0103ta mai \u00eenainte \u2013 de c\u0103tre Comisia de drept interna\u0163ional a O.N.U. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aceste  demersuri au fost \u00eemplinite la Conferin\u0163a diplomatic\u0103 a  plenipoten\u0163ialilor Na\u0163iunilor Unite asupra \u00eenfiin\u0163\u0103rii unei Cur\u0163i penale  interna\u0163ionale desf\u0103\u015furat\u0103 la Roma \u00een perioada 15 iunie \u2013 17 iulie 1998  cand a fost adoptat Statutul de la Roma al Cur\u0163ii penale  interna\u0163ionale. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Din 148 de state prezente la vot au votat 120 de state \u2013 printre care \u015fi Romania \u2013 7 au fost \u00eempotriv\u0103 \u015fi 21 s-au ab\u0163inut. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A \u00eenvins la Roma&nbsp; viziunea  modern\u0103, actual\u0103 c\u0103 \u00eentr-o lume global\u0103 trebuie s\u0103 prevaleze conven\u0163ia  interna\u0163ional\u0103 fa\u0163\u0103 de dreptul intern \u00een detrimentul unei viziuni  autarhice ce punea accent pe prerogativele suverane ale statului mai  ales \u00eentr-un domeniu pe atat de sensibil pe atat de conservator cum este  cel al justi\u0163iei. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O  atare pozi\u0163ie a avut-o f\u0103r\u0103 rezerve \u015fi Rom\u00e2nia care nu numai c\u0103 a  semnat Statutul de la Roma dar \u00een prima parte a anului 2002 \u00een martie  Rom\u00e2nia a ratificat acest Statut \u2013 a se vedea Legea nr. 111\/ 2002 pentru  ratificarea acestui Statut \u2013 r\u0103spunz\u00e2nd astfel generos, \u00een timp,  ilustrului ei \u00eenainta\u015f Vespasian Pella, cel care a aruncat \u201csc\u00e2nteia  creatoare\u201d a unei astfel de justi\u0163ii interna\u0163ionale penale. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u015ei totu\u015fi, orice \u00eenceput, fie el al unei justi\u0163ii interna\u0163ionale penale \u00ee\u015fi are limitele sale, cum ar fi: <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>De\u015fi  Curtea se declar\u0103 competent\u0103 \u00een art. 5 din Statut asupra crimei de  genocid, crimelor \u00eempotriva umanit\u0103\u0163ii, crimelor de r\u0103zboi \u015fi crimelor  de agresiune, \u00een privin\u0163a crimei de agresiune \u2013 care se afl\u0103 la originea  oric\u0103rei crime de r\u0103zboi \u2013 aceasta nu poate fi instrumentat\u0103 dec\u00e2t dup\u0103  definirea ei \u015fi dup\u0103 acceptarea ei ca amendament. Dac\u0103 se ia \u00een  considerare c\u0103 orice amendament nu poate fi propus \u00eenainte de 7 ani de  la data intr\u0103rii \u00een vigoare a statutului \u015fi care la randul s\u0103u trebuie  s\u0103 fie ratificat de c\u0103tre state, atunci este clar, c\u0103 numai peste cel  pu\u0163in 7-8 ani o atare crim\u0103 interna\u0163ional\u0103 poate fi instrumentat\u0103. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Mai  mult, conform art. 12 din Statut tot pentru o perioad\u0103 de 7 ani de la  intrarea \u00een vigoare a Statutului statele p\u0103r\u0163i pot s\u0103 declare c\u0103 nu  accept\u0103 jurisdic\u0163ia Cur\u0163ii \u00een privin\u0163a crimei de r\u0103zboi \u2013 cele mai  frecvente \u015fi barbare dintr-o atare perioad\u0103 de conflict \u2013 c\u00e2nd se  presupune c\u0103 o astfel de crim\u0103 a fost comis\u0103 pe teritoriul s\u0103u de  cet\u0103\u0163enii s\u0103i. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Acest  Statut deja aprobat nu este suficient \u015fi trebuie completat de un  Proiect de reguli de procedur\u0103 \u015fi proba\u0163iune \u015fi un altul pentru  \u201cdefinirea Elementelor crimelor\u201d.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>Interesant  de subliniat c\u0103 \u00een Statut nu a fost calificat\u0103 ca \u201carm\u0103 criminal\u0103\u201d  interzis\u0103 de dreptul interna\u0163ional bomba atomic\u0103, dar paradoxal a fost  incriminat glon\u0163ul \u201cdum-dum\u201d.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; margin: 0cm; text-align: justify; text-indent: 0cm;\">\n<span style=\"font-family: Symbol;\">\u00a8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span>\u00cen  fine, interesant de men\u0163ionat este faptul c\u0103 nu au fost incluse \u00een  statut crimele at\u00e2t de grave ale omenirii actuale: traficul ilicit de  droguri \u015fi terorismul.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n\u00cen  leg\u0103tur\u0103 cu terorismul de precizat c\u0103 nici de aceast\u0103 dat\u0103 o crim\u0103 ce  \u00eenfioar\u0103 groaznic comunitatea interna\u0163ional\u0103 nu \u015fi-a g\u0103sit cadrul  juridic procesual concret de instrumentare \u015fi judecare. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Alt  cadru mai potrivit \u015fi mai eficient dec\u00e2t sub emblema O.N.U., \u00een opinia  noastr\u0103, nu poate fi \u015fi, cum Curtea penal\u0103 interna\u0163ional\u0103 a fost  \u00eenfiin\u0163at\u0103 sub egida O.N.U., \u00een cadrul acestei Cur\u0163i, sub jurisdic\u0163ia  acesteia terorismul poate s\u0103 fie judecat. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De  altfel, la Haga \u00een cadrul Cur\u0163ii penale interna\u0163ionale \u00een acest for  juridic de mare amplitudine \u015fi rezonan\u0163\u0103 se pot concentra \u015fi totodat\u0103 se  pot solu\u0163iona cauzele penale interna\u0163ionale av\u00e2nd ca obiect crimele  cele mai grave prin care sunt lezate \u015fi atacate valorile supreme ale  comunit\u0103\u0163ii interna\u0163ionale pacea \u015fi securitatea.<\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; R\u0103zboiul  mondial \u00eempotriva terorismului a fost declan\u015fat. Statele Unite ale  Americii au fost lovite din plin \u015fi \u00een consecin\u0163\u0103 riposta este oportun\u0103  \u015fi necesar\u0103. P\u00e2n\u0103 la urm\u0103 terori\u015ftii \u2013 cei mai mul\u0163i dintre ei \u2013 vor fi  prin\u015fi \u015fi deferi\u0163i justi\u0163iei. <\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Curtea penal\u0103 interna\u0163ional\u0103 poate oferi cadrul procesual juridic al&nbsp; unei justi\u0163ii penale interna\u0163ionale eficiente privind tragerea la r\u0103spundere penal\u0103 a autorilor actelor de terorism.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;De  aceea e necesar ca aceast\u0103 Curte penal\u0103 interna\u0163ional\u0103 s\u0103 nu r\u0103m\u00e2n\u0103  numai un reper al trecutului ci trebuie s\u0103 se proiecteze cu putere \u00een  viitor.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nExist\u0103  totu\u015fi o rezerv\u0103 ce strecoar\u0103 o anume \u00eendoial\u0103: de ce nu se schimb\u0103  mentalitatea american\u0103? De ce soldatul american se supune, numai \u015fi  numai, unei justi\u0163ii americane \u015fi nu interna\u0163ionale?<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nExist\u0103  o lupt\u0103 comun\u0103, un front comun \u00eempotriva terorismului \u015fi, \u00een  consecin\u0163\u0103, trebuie s\u0103 fie \u015fi o justi\u0163ie comun\u0103 neselectiv\u0103 c\u0103reia s\u0103 i  se supun\u0103 atat cet\u0103\u0163eanul european cat \u015fi cet\u0103\u0163eanul american. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nDin  p\u0103cate Statele Unite ale Americii au fost printre cele 7 \u0163\u0103ri \u2013 din 148  \u2013 care au votat contra Statutului Cur\u0163ii penale interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nMai  mult, o dat\u0103 adoptat Statutul, Statele Unite ale Americii au semnat  Tratatul pe 31 decembrie 2000 dar acesta nu a fost ratificat de  parlamentarii americani de\u015fi alia\u0163i Statelor Unite cum ar fi Marea  Britanie, Germania, Fran\u0163a au ratificat acest Tratat. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nDe  asemenea, \u00een luna mai 2002 Statele Unite s-au retras din Tratatul care a  creat aceast\u0103 Curte renun\u0163\u00e2nd la angajamentul pe care \u015fi l-au luat de a  nu face nimic pentru a afecta \u201cscopul \u015fi obiectivele Tratatului\u201d.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n\u015ei  totu\u015fi terorismul a declan\u015fat multe \u015fi profunde muta\u0163ii, at\u00e2tea \u015fi  at\u00e2tea atitudini, alian\u0163e care p\u0103reau imposibile odat\u0103 au devenit  realitate \u015fi \u00een acest context, de ce oare nu s-ar declan\u015fa \u015fi o  schimbare fundamental\u0103 \u00een optica american\u0103 privind justi\u0163ia  interna\u0163ional\u0103? <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nAstfel,  de ce oare SUA n-ar renun\u0163a la politica sa actual\u0103 de a \u00eencheia cu  fiecare stat tratate bilaterale prin care militarii s\u0103i s\u0103 fie sco\u015fi de  sub jurisdic\u0163ia unei instan\u0163e interna\u0163ionale penale \u015fi supu\u015fi numai unei  justi\u0163ii americane?<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\nR\u0103zboiul  \u00eempotriva terorismului a fost declan\u015fat. Afganistanul a fost o \u0163int\u0103,  Irakul este ast\u0103zi alt\u0103 \u0163int\u0103 \u015fi \u00een mod, sigur vor urma \u015fi altele.  America \u00eempreun\u0103 cu \u00eentreaga comunitate interna\u0163ional\u0103 a pornit la o  lupt\u0103 de durat\u0103 \u00eempotriva terorismului. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n\u00cen acest front comun trebuie s\u0103 fie \u00eens\u0103 \u015fi o justi\u0163ie comun\u0103. <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n\u201cNimeni nu este mai presus de lege\u201d proclam\u0103 un dicton rom\u00e2nesc constitu\u0163ional.
