margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n1<i>.&nbsp; Probleme de principiu<\/i>.Recurgerea  la for\u0163a armat\u0103 \u00eempotriva suveranit\u0103\u0163ii \u015fi integrit\u0103\u0163ii teritoriale a  statelor este ast\u0103zi interzis\u0103 \u00een baza principiului nerecurgerii la  for\u0163\u0103, principiu fundamental al dreptului interna\u0163ional contemporan, iar  agresiunea armat\u0103 este considerat\u0103 drept cea mai grav\u0103 crim\u0103  interna\u0163ional\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dreptul  interna\u0163ional permite, \u00eens\u0103, ca for\u0163a armat\u0103 s\u0103 fie folosit\u0103 drept  mijloc de ultim recurs pentru contracararea actelor de agresiune,  statele put\u00e2nd s\u0103 utilizeze for\u0163ele lor armate \u00eempotriva altor state  care \u00eencalc\u0103 grav legalitatea interna\u0163ional\u0103, pentru a-\u015fi ap\u0103ra propria  integritate teritorial\u0103, independen\u0163a \u015fi suveranitatea \u015fi pentru  sanc\u0163ionarea agresorului, \u00een care sens sunt \u00een drept s\u0103 adopte \u00een  propriul teritoriu m\u0103suri adecvate de natur\u0103 a le permite realizarea  scopurilor ar\u0103tate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  realizarea uneia din principalele sale func\u0163ii, de a men\u0163ine pacea \u015fi  securitatea interna\u0163ional\u0103, Carta O.N.U. cuprinde un sistem complex de  sanc\u0163ionare, \u00een colectiv, a agresorului de c\u0103tre statele membre, menit a  asigura restabilirea legalit\u0103\u0163ii interna\u0163ionale, \u00eenl\u0103turarea actelor de  agresiune \u015fi a urm\u0103rilor acestora, repunerea \u00een drepturi a statului  lezat \u015fi prevenirea unor noi \u00eenc\u0103lc\u0103ri.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sisteme  similare de asigurare a securit\u0103\u0163ii interna\u0163ionale func\u0163ioneaz\u0103 \u015fi \u00een  plan zonal, \u00een cazul organiza\u0163iilor interna\u0163ionale regionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta  O.N.U. recunoa\u015fte \u00een acela\u015fi timp \u015fi dreptul la autoap\u0103rare al fiec\u0103rui  stat care, \u00een caz de agresiune, este \u00eendrept\u0103\u0163it s\u0103 riposteze prin  toate mijloacele care-i stau la \u00eendem\u00e2n\u0103, fie \u00een mod individual, fie  \u00eempreun\u0103 cu alte state cu care se afl\u0103 \u00een rela\u0163ii de alian\u0163\u0103  politico-militar\u0103 bilateral\u0103 sau multilateral\u0103, pentru acordarea de  ajutor mutual \u00een caz de atac armat.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Recunoa\u015fterea  dreptului la autodeterminare al popoarelor a dus \u00een planul dreptului la  legitimarea luptei armate duse de popoarele coloniale \u015fi dependente  \u00eempotriva asupritorilor, recurgerea la for\u0163a armelor&nbsp; de  c\u0103tre aceste popoare \u00eencadr\u00e2ndu-se \u00een situa\u0163iile legitime de folosire a  for\u0163ei, ca ripost\u0103 la exercitarea ilegal\u0103 de c\u0103tre statele metropol\u0103 a  unor constr\u00e2ngeri la adresa libert\u0103\u0163ii \u015fi independen\u0163ei lor.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Situa\u0163iile  \u00een care for\u0163a armat\u0103 poate fi folosit\u0103 \u00een mod legal pentru sanc\u0163ionarea  agresiunii sunt, deci, urm\u0103toarele: de c\u0103tre Organiza\u0163ia Na\u0163iunilor  Unite, ca sistem universal de securitate; de c\u0103tre organiza\u0163iile  regionale, sub controlul O.N.U.; de c\u0103tre fiecare stat \u00een parte,  potrivit dreptului la autoap\u0103rare individual\u0103 sau colectiv\u0103; de c\u0103tre  popoarele coloniale sau dependente \u00eempotriva \u0163\u0103rilor care exercit\u0103  asupra lor o domina\u0163ie ilegal\u0103, contrar\u0103 normelor dreptului  interna\u0163ional \u015fi Cartei O.N.U..<\/div>\n<p><a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\"><\/a><\/p>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta  O.N.U. prevede \u00een art. 53 \u015fi 107 \u015fi posibilitatea folosirii for\u0163ei  \u00eempotriva statelor foste inamice puterilor aliate \u015fi asociate \u00een cel  de-al doilea \u0103zboi mondial, \u00eentre care s-ar \u00eencadra \u015fi \u0163ara noastr\u0103,  m\u0103sur\u0103 ce era menit\u0103 a contracara o eventual\u0103 politic\u0103 revan\u015fard\u0103 din  partea acestora, cum se \u00eent\u00e2mplase dup\u0103 primul r\u0103zboi mondial, \u015fi a  asigura respectarea clauzelor tratatelor de pace.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prevederile  articolelor respective, de\u015fi \u00eenc\u0103 \u00een vigoare \u00een mod formal, au devenit  caduce, \u00een condi\u0163iile \u00een care statele respective sunt ast\u0103zi membre ale  O.N.U. \u015fi s-au angajat s\u0103 duc\u0103 o politic\u0103 de pace \u015fi de respectare a  dreptului interna\u0163ional al\u0103turi de celelalte state ale lumii.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n2.&nbsp;&nbsp; <i>Folosirea for\u0163ei de c\u0103tre Organiza\u0163ia Na\u0163iunilor Unite<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta  O.N.U. proclam\u0103 \u00een preambulul s\u0103u hot\u0103r\u00e2rea statelor membre de a-\u015fi uni  eforturile pentru men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale, de a  accepta principii \u015fi a institui metode \u201e care s\u0103 garanteze c\u0103 for\u0163a  armat\u0103 nu va fi folosit\u0103 dec\u00e2t \u00een interesul lor comun\u201d.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Statele &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; membre  ale O.N.U. s-au angajat s\u0103-\u015fi garanteze reciproc securitatea \u015fi s\u0103  contribuie prin toate mijloacele conforme cu dreptul interna\u0163ional la  reprimarea agresiunii indiferent unde, din partea cui \u015fi \u00eempotriva cui  s-ar produce aceasta.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mijloacele  prev\u0103zute de Carta O.N.U. pentru men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii  interna\u0163ionale, asigurarea legalit\u0103\u0163ii interna\u0163ionale \u015fi ap\u0103rarea  drepturilor statelor sunt, \u00een caz de diferend sau de conflict  interna\u0163ional, at\u00e2t mijloacele pa\u015fnice cunoscute, c\u00e2t \u015fi, \u00een caz de  viol\u0103ri ale p\u0103cii sau de acte de agresiune, m\u0103suri bazate pe for\u0163\u0103, fie  c\u0103 aceasta implic\u0103 sau nu folosirea for\u0163ei armate. Ele sunt cuprinse&nbsp; \u00een  Capitolul VI al Cartei, intitulat, \u201e Ac\u0163iunea \u00een caz de amenin\u0163\u0103ri  \u00eempotriva p\u0103cii, de \u00eenc\u0103lc\u0103ri ale p\u0103cii \u015fi de acte de agresiune\u201d.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mecanismul&nbsp; prev\u0103zut  \u00een acest sens de Carta O.N.U. este destul de complex, principalelor  organisme ale organiza\u0163iei mondiale (Adunarea General\u0103 \u015fi Consiliul de  Securitate) stabilindu-li-se atribu\u0163ii, drepturi \u015fi obliga\u0163ii precise  privind folosirea for\u0163ei, inclusiv a for\u0163ei armate. Un rol important  joac\u0103 \u00een acest domeniu \u015fi secretarul general al O.N.U.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 1) <i>Adunarea&nbsp; General\u0103 a O.N.U.<\/i> are un rol relativ limitat \u00een rezolvarea unor situa\u0163ii conflictuale ce ar ap\u0103rea \u00eentre membrii organiza\u0163iei.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pe  de o parte, ea se poate pronun\u0163a asupra oric\u0103rei situa\u0163ii ce ar  constitui o amenin\u0163are la adresa p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale, \u00een  baza competen\u0163ei sale generale de a analiza \u015fi dezbate orice problem\u0103  ce intr\u0103 \u00een sfera de preocup\u0103ri a organiza\u0163iei, iar pe de alt\u0103 parte, \u00een  caz de diferend \u00eentre statele membre, poate face recomand\u0103ri asupra  modului de solu\u0163ionare at\u00e2t statelor implicate, c\u00e2t \u015fi Consiliului de  Securitate, acestuia din urm\u0103 fie din oficiu , dac\u0103 nu s-a sesizat el  \u00eensu\u015fi cu situa\u0163ia sau diferendul respectiv, fie la cererea acestuia,  dac\u0103 s-a sesizat el \u00eensu\u015fi.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Adunarea  General\u0103 nu poate s\u0103 \u00eentreprind\u0103 m\u0103suri bazate pe for\u0163\u0103 \u015fi cu at\u00e2t mai  mult nu poate dispune recurgerea la for\u0163a armat\u0103 \u00eempotriva unui stat  care prin conduita sa culpabil\u0103 a dat na\u015ftere unui diferend sau unei  situa\u0163ii interna\u0163ionale, sau care \u00een mod deliberat a recurs la acte de  agresiune \u00eempotriva altui stat.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De\u015fi  limitat\u0103 prin prevederile Cartei O.N.U. \u00een posibilit\u0103\u0163ile ei legale de a  ac\u0163iona direct asupra situa\u0163iilor concrete \u00een care pacea \u015fi  suveranitatea sunt tulburate sau amenin\u0163ate, Adunarea General\u0103 a  \u00eendeplinit \u015fi \u00eendepline\u015fte \u00een continuare un rol important \u00een  solu\u0163ionarea unor probleme de ordin general&nbsp; de  aceast\u0103 natur\u0103, adopt\u00e2nd decizii (declara\u0163ii \u015fi rezolu\u0163ii) care exprim\u0103  lu\u0103ri de pozi\u0163ie nete \u00eempotriva unor acte de agresiune \u015fi care exercit\u0103 o  influen\u0163\u0103 pozitiv\u0103 pe plan interna\u0163ional, pentru dezamorsarea unor  situa\u0163ii conflictuale \u015fi solu\u0163ionarea acestora \u00een spiritul dreptului  interna\u0163ional, al asigur\u0103rii p\u0103cii mondiale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2) <i>Consiliul de Securitate al O.N.U.<\/i>  are, potrivit Cartei, o pozi\u0163ie cu totul special\u0103 \u00een sistemul de  rezolvare a situa\u0163iilor \u015fi diferendelor care ar primejdui pacea \u015fi  securitatea interna\u0163ional\u0103, el av\u00e2nd&nbsp; \u201e principala  r\u0103spundere pentru men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale\u201d (art.  24) \u015fi fiind abilitat ca \u00een \u00eendeplinirea \u00eendatoririlor sale decurg\u00e2nd  din aceast\u0103 r\u0103spundere, s\u0103 ac\u0163ioneze \u00een numele statelor membre, acestea  oblig\u00e2ndu-se s\u0103-i accepte \u015fi s\u0103-i execute hot\u0103r\u00e2rile .<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; M\u0103surile  pe care le poate lua Consiliul de Securitate \u00een caz de amenin\u0163are  contra p\u0103cii, viol\u0103ri ale p\u0103cii sau acte de agresiune sunt prev\u0103zute \u00een  Capitolul VII al Cartei O.N.U., care cuprinde \u015fi principalele atribu\u0163ii  ale Consiliului de Securitate \u00een domeniul realiz\u0103rii securit\u0103\u0163ii \u015fi  p\u0103cii interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Potrivit  Cartei (art. 39) Consiliul de Securitate are at\u00e2t competen\u0163a de a  constata existen\u0163a unei amenin\u0163\u0103ri contra p\u0103cii, a unei viol\u0103ri a p\u0103cii  sau a unui act de agresiune, c\u00e2t \u015fi pe aceea de a ac\u0163iona \u00een mod  corespunz\u0103tor pentru men\u0163inerea p\u0103cii.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>Constatarea<\/i>  existen\u0163ei uneia din situa\u0163iile care reclam\u0103 interven\u0163ia Consiliului de  Securitate se poate face at\u00e2t din oficiu, c\u00e2t \u015fi la sesizarea unui alt  organ al O.N.U. sau a unor state, indiferent dac\u0103 statele respective  sunt sau nu implicate direct.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>Ac\u0163iunea<\/i> Consiliului de Securitate const\u0103 \u00een adoptarea unor recomand\u0103ri sau a unor hot\u0103r\u00e2ri, \u00een func\u0163ie de situa\u0163ie.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>Recomand\u0103rile <\/i>nu au caracter obligatoriu, pe aceast\u0103&nbsp; cale nu se pot lua m\u0103suri de constr\u00e2ngere, ci doar se pot indica procedurile \u015fi metodele pentru rezolvarea situa\u0163iei.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Hot\u0103r\u00e2rile  stabilesc m\u0103suri concrete menite a duce la men\u0163inerea sau, dup\u0103 caz, la  restabilirea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale. Consiliul de  Securitate este \u00een drept s\u0103 decid\u0103, cu caracter obligatoriu, luarea de  m\u0103suri provizorii sau de m\u0103suri definitive, care pot s\u0103 implice sau nu  folosirea for\u0163ei armate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; a<i>) M\u0103surile provizorii<\/i>  se iau \u00een scopul de a preveni agravarea unei situa\u0163ii cionstatate ca  atare, \u00eenainte de cercetarea am\u0103nun\u0163it\u0103 a acesteia \u015fi de adoptarea unor  recomand\u0103ri sau hot\u0103r\u00e2ri pentru solu\u0163ionarea pe fond a conflictului.  Carta nu indic\u0103 \u00een ce ar putea&nbsp; consta&nbsp; asemenea  m\u0103suri provizorii pentru a nu \u00eengr\u0103di aprecierea Consiliului de  Securitate \u00een raport cu situa\u0163iile concrete, care pot fi&nbsp; foarte  variate .Asemenea m\u0103suri pot consta, de exemplu, dintr-un ordin de  \u00eencetare a focului, din instituirea unui moratoriu, oprirea \u00eenaint\u0103rii  trupelor \u015fi altele asemenea.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  caz de neconformare a p\u0103r\u0163ilor fa\u0163\u0103 de m\u0103surile cu caracter provizoriu  dispuse de Consiliul de Securitate, acesta este \u00eemputernicit s\u0103 \u0163in\u0103  seama \u00een modul cuvenit de refuzul respectiv \u00een cursul desf\u0103\u015fur\u0103rii  ulterioare a evenimentelor, la aprecierea pozi\u0163iei \u015fi a r\u0103spunderii  fiec\u0103reia dintre p\u0103r\u0163i.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; M\u0103surile  provizorii trebuie s\u0103 fie de a\u015fa natur\u0103 \u00eenc\u00e2t s\u0103 nu prejudicieze  drepturile , preten\u0163iile sau pozi\u0163ia p\u0103r\u0163ilor interesate \u015fi s\u0103 nu  avantajeze pe vreuna din p\u0103r\u0163i.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; b) <i>M\u0103surile definitive<\/i> pot s\u0103 fie de dou\u0103 feluri: cele care nu implic\u0103 folosirea for\u0163ei armate \u015fi cele bazate pe folosirea for\u0163ei armate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; M\u0103surile  care nu implic\u0103 folosirea for\u0163ei armate pot s\u0103 se refere la izolarea  interna\u0163ional\u0103 a statului \u00een culp\u0103 sau la crearea unor dificult\u0103\u0163i  pentru pozi\u0163ia politic\u0103 interna\u0163ional\u0103 \u015fi pentru economia acestuia, prin  exercitarea de presiuni, \u00een scopul de a-l determina astfel s\u0103-\u015fi  corijeze conduita, s\u0103 renun\u0163e la actele sale condamnabile \u015fi s\u0103 reintre  \u00een legalitate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  cadrul acestor m\u0103suri Consiliul de Securitate poate s\u0103 cear\u0103 statelor  membre ale O.N.U. s\u0103 \u00eentrerup\u0103 total sau par\u0163ial rela\u0163iile economice,  comunica\u0163iile feroviare, maritime, aeriene, po\u015ftale, telegrafice, prin  radio sau prin alte mijloace de comunica\u0163ie cu statul supus m\u0103surilor de  sanc\u0163ionare, sau s\u0103 \u00eentrerup\u0103 rela\u0163iile diplomatice cu acesta ( art. 41  al Cartei O.N.U.).<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De\u015fi  nu implic\u0103 folosirea for\u0163ei armate, asemenea m\u0103suri au caracter de  constr\u00e2ngere \u015fi prezint\u0103 o gravitate deosebit\u0103 pentru statele \u00eempotriva  c\u0103rora se iau. Ele nu mai au drept scop, ca \u00een cazul m\u0103surilor  provizorii, conservarea pozi\u0163iei p\u0103r\u0163ilor \u00een conflict la un moment dat,  ci sanc\u0163ionarea acelora care nu s-au conformat hot\u0103r\u00e2rilor anterioare \u015fi  continu\u0103 conduita lor ilicit\u0103. Luarea unor asemenea m\u0103suri presupune o  atitudine clar\u0103, tran\u015fant\u0103, din partea Consiliului de Securitate \u00een  favoarea uneia sau alteia din p\u0103r\u0163ile aflate \u00een conflict, o condamnare a  statelor vinovate de tulbur\u0103ri ale p\u0103cii, de viol\u0103ri ale p\u0103cii sau de  acte de agresiune.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>M\u0103surile bazate pe folosirea for\u0163ei armate<\/i>  se iau \u00een cazul \u00een care m\u0103surile cu caracter provizoriu, recomand\u0103rile  Adun\u0103rii Generale sau ale Consiliului de Securitate, precum \u015fi m\u0103surile  luate de Consiliul de Securitate care nu implic\u0103 folosirea for\u0163ei  armate, s-au dovedit ineficiente.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  aceast\u0103 situa\u0163ie Consiliul de Securitate poate s\u0103 \u00eentreprind\u0103, prin  folosirea for\u0163elor terestre, navale sau aeriene ale membrilor  organiza\u0163iei, orice ac\u0163iune pe care o consider\u0103 necesar\u0103 pentru  men\u0163inerea sau restabilirea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta  prevede asemenea m\u0103suri numai cu caracter enunciativ, men\u0163ion\u00e2nd  demonstra\u0163iile militare , m\u0103surile de blocad\u0103 \u015fi alte opera\u0163ii executate  de for\u0163ele maritime, terestre sau aeriene ( art. 42).<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pentru exercitarea atribu\u0163iilor Consiliului de Securitate, Carta O.N.U. a prev\u0103zut un <i>mecanism de constituire \u015fi de utilizare a for\u0163elor armate ale organiza\u0163iei<\/i>, care s\u0103 fie \u00een m\u0103sur\u0103 s\u0103 angajeze ac\u0163iuni militare asupra statelor \u00een culp\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 43 al Cartei O.N.U.&nbsp; prevede  obliga\u0163ia statelor membre de a pune la dispozi\u0163ia Consiliului de  Securitate for\u0163e armate \u015fi de a-i acorda sprijinul \u015fi facilit\u0103\u0163ile  necesare, inclusiv dreptul de trecere a trupelor peste teritoriul lor,  \u00een vederea execut\u0103rii m\u0103surile de men\u0163inere a p\u0103cii.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Contribu\u0163ia  cu for\u0163e armate , sprijinul \u015fi facilit\u0103\u0163ile, nu se angajeaz\u0103 \u00eens\u0103  automat, ci sunt condi\u0163ionate de \u00eendeplinirea cumulativ\u0103 a dou\u0103  condi\u0163ii: formularea unei cereri exprese din partea Consiliului de  Securitate \u015fi \u00eencheierea unor acorduri \u00eentre Consiliu pe de o parte \u015fi  membrii organiza\u0163iei, individual sau \u00een grup, pe de alt\u0103 parte.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Utilizarea  \u00een lupt\u0103 a efectivelor puse la dispozi\u0163ia O.N.U. trebuie s\u0103 se fac\u0103,  potrivit Cartei, dup\u0103 planurile preg\u0103tite de Consiliul de Securitate cu  ajutorul unui Comitet de stat major, statele care particip\u0103 cu for\u0163e  armate av\u00e2nd, \u00eens\u0103, dreptul s\u0103 fie invitate la adoptarea de c\u0103tre  Consiliul de Securitate a hot\u0103r\u00e2rilor privind utilizarea for\u0163elor lor  armate.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Caracterul  sumar al prevederilor Cartei, ca \u015fi sistemul prev\u0103zut pentru angajarea  \u015fi conducerea for\u0163elor armate ale O.N.U., au determinat ca problema  constituirii unor asemenea for\u0163e s\u0103 depind\u0103 \u00een ultim\u0103 instan\u0163\u0103 de  factori politici conjuncturali, practic de voin\u0163a marilor puteri membre  permanente ale Consiliului de Securitate, astfel c\u0103, p\u00e2n\u0103 \u00een prezent, nu  s-au \u00eencheiat asemenea acorduri \u00eenc\u0103 din timp de pace \u015fi, ca urmare ,  nici nu s-au constituit for\u0163ele militare ale O.N.U. \u00een conformitate cu  prevederile capitolului VII al Cartei.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mecanismul  prev\u0103zut de Carta O.N.U. a func\u0163ionat doar cu caracter ad-hoc \u00een cazul  agresiunii s\u0103v\u00e2r\u015fite de Irak \u00een 1990 \u00eempotriva statului Kuweit, pe care  l-a invadat&nbsp; \u015fi l-a anexat. Dup\u0103 anexare, prin  rezolu\u0163ii ale Adun\u0103rii Generale a O.N.U. , s-a cerut Irakului eliberarea  Kuweitului, iar ca urmare a refuzului statului agresor Consiliul de  Securitate a instituit o blocad\u0103 total\u0103 \u015fi a invitat mai multe state  s\u01030i pun\u0103 la dispozi\u0163ie trupe pentru reprimarea agresiunii \u015fi eliberarea  Kuweitului.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Trupele  puse la dispozi\u0163ia Consiliului de Securitate, \u00een special de c\u0103tre  Statele Unite ale Americii, au declan\u015fat in ianuarie 1991 opera\u0163iunea \u201e  Furtuna de\u015fertului\u201d \u00een urma c\u0103reia Kuweitul a fost eliberat, iar  Irakului i s-au pus o serie de condi\u0163ii, \u00eentre care restituirea  bunurilor ridicate din Kuweit, plata repara\u0163iilor pentru daunele cauzate  \u015fi distrugerea armamentului&nbsp; de nimicire \u00een mas\u0103,  p\u00e2n\u0103 la \u00eendeplinirea acestor condi\u0163ii men\u0163in\u00e2ndu-se \u00een continuare  blocada instituit\u0103 \u015fi exercit\u00e2ndu-se un control asupra \u00eendeplinirii  obliga\u0163iilor stabilite.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Cu  toate c\u0103 mecanismul prev\u0103zut de Carta O.N.U. pentru men\u0163inerea p\u0103cii \u015fi  securit\u0103\u0163ii interna\u0163ionale \u015fi reprimarea oric\u0103rei agresiuni prin  folosirea for\u0163ei armate nu a func\u0163ionat dec\u00e2t \u00een mic\u0103 m\u0103sur\u0103, el este \u015fi  r\u0103m\u00e2ne \u00eenc\u0103 \u00een vigoare, dispozi\u0163iile corespunz\u0103toare nefiind abrogate,  iar noile condi\u0163ii ale rela\u0163iilor interna\u0163ionale, ap\u0103rute ca urmare a  sf\u00e2r\u015fitului bipolarit\u0103\u0163ii mondiale, ar putea crea un cadru nou, care s\u0103  faciliteze punerea lor \u00een aplicare \u00een situa\u0163iile prev\u0103zute de Cart\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>For\u0163ele multina\u0163ionale de men\u0163inere a p\u0103cii<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De\u015fi  for\u0163ele armate ale O.N.U. nu s-au putut constitui conform Cartei,  organiza\u0163ia mondial\u0103 a fost totu\u015fi prezent\u0103 cu efective militare ale  statelor membre \u00een numeroase situa\u0163ii conflictuale \u015fi crize  politico-militare ce au avut loc \u00een ultimele decenii \u00een diferite regiuni  ale lumii, adic\u00e2nd adesea o contribu\u0163ie pozitiv\u0103 la rezolvarea sau  diminuarea propor\u0163iilor acestora.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Rolul  \u00eendeplinit de aceste for\u0163e armate nu este, \u00eens\u0103, cel prev\u0103zut de  capitolul VII al Cartei O.N.U. \u2013 constr\u00e2ngerea agresorului s\u0103 \u00eenceteze  actele sale agresive \u015fi restabilirea p\u0103cii \u015fi securit\u0103\u0163ii  interna\u0163ionale, prin implicarea direct\u0103 \u00een opera\u0163iile militare \u00eempotriva  statului agresor \u2013 ci unul de o factur\u0103 diferit\u0103, de prevenire a  agrav\u0103rii conflictelor armate declan\u015fate \u015fi de garantare c\u0103 anumite  aranjamente politico-militare la care s-a ajuns pe parcurs \u00een situa\u0163ia  interna\u0163ional\u0103 ce s-a creat sunt respectate de p\u0103r\u0163ile implicate, f\u0103r\u0103 a  lua, \u00een general, atitudine activ\u0103 \u015fi diferen\u0163iat\u0103 \u00een favoarea vreuneia  dintre p\u0103r\u0163i, considerat\u0103 ca victim\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; For\u0163ele  multina\u0163ionale de men\u0163inere a p\u0103cii, indiferent de denumirea concret\u0103 a  acestora sau de misiunile pe care le au de \u00eendeplinit, au \u00eentotdeauna  un caracter ad-hoc, ele constituindu-se de c\u0103tre Adunarea General\u0103 sau  de Consiliul de Securitate al O.N.U. pe perioade determinate \u015fi pentru  un conflict anume.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Crearea  acestor for\u0163e reprezint\u0103 o solu\u0163ie original\u0103, izvor\u00e2t\u0103 din necesit\u0103\u0163ile  \u015fi realit\u0103\u0163ile contemporane, inspirat\u0103, \u00een esen\u0163a sa, din principii  generale ale Cartei.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n3. <i>Rolul organiza\u0163iilor interna\u0163ionale regionale \u00een folosirea for\u0163ei<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta O.N.U., \u00een capitolul VIII, prevede \u015fi posibilitatea ca for\u0163a s\u0103 fie folosit\u0103 sub egida O.N.U. &nbsp;de  c\u0103tre organiza\u0163iile interna\u0163ionale \u2013 acorduri \u015fi organisme \u2013 care au \u00een  preocup\u0103rile lor probleme privind men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii  interna\u0163ionale \u00een cadru regional, dac\u0103 organizarea \u015fi activitatea  acestora sunt compatibile cu scopurile \u015fi principiile O.N.U.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen concep\u0163ia Cartei, rolul organiza\u0163iilor interna\u0163ionale de securitate este limitat \u015fi, \u00een mare parte, subordonat O.N.U.&nbsp; Menirea  lor este ca, al\u0103turi de O.N.U. , s\u0103 promoveze rezolvarea pe cale  pa\u015fnic\u0103 a diferendelor interna\u0163ionale ci caracter local, iar sub egida  acesteia, s\u0103 participe la rezolvarea oric\u0103ror diferende, inclusiv prin  aplicarea unor m\u0103suri de constr\u00e2ngere, rolul lor fiind astfel de a  completa mecanismul centralizat de securitate colectiv\u0103 cu contribu\u0163ia  pe care , pe plan zonal, o pot aduce la limitarea efectelor asupra p\u0103cii  \u015fi securit\u0103\u0163ii interna\u0163ionale ale diferendelor \u015fi altor situa\u0163ii  periculoase, la rezolvarea mai operativ\u0103 a acestora.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Potrivit  Cartei, organiza\u0163iile regionale trebuie s\u0103 informeze permanent \u015fi  complet Consiliul de Securitate al ONU asupra ac\u0163iunilor pe care le  \u00eentreprind sau le preg\u0103tesc pentru men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii  interna\u0163ionale, ele nu pot \u00eentreprinde nici o m\u0103sur\u0103 de constr\u00e2ngere  f\u0103r\u0103 autorizarea Consiliului de Securitate, iar Consiliul de Securitate  la r\u00e2ndul s\u0103u poate utiliza asemenea acorduri sau organisme regionale  pentru aplicarea m\u0103surilor de constr\u00e2ngere sub autoritatea sa.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n4.&nbsp; <i>Dreptul statelor la autoap\u0103rare individual\u0103 sau colectiv\u0103<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 51 al Cartei O.N.U. stipuleaz\u0103 c\u0103 nici o dispozi\u0163ie a Cartei \u201e nu va aduce&nbsp; atingere  dreptului inerent al dreptului la autoap\u0103rare individual\u0103 sau  colectiv\u0103, \u00een cazul \u00een care se produce un atac armat \u00eempotriva unui  membru al Na\u0163iunilor Unite&#8230;\u201d<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dreptul legitim&nbsp; la  autoap\u0103rare \u00een forma consacrat\u0103 de Carta O.N.U. este rezultatul unei  \u00eendelungi evolu\u0163ii, de la dreptul de autoprotec\u0163ie recunoscut ca legal  sub diferite forme ( autoconservarea, autoap\u0103rarea preventiv\u0103,  autoajutorarea etc.) la situa\u0163ia de ast\u0103zi c\u00e2nd statele au dreptul de a  recurge la for\u0163a armelor numai \u00een cazul \u00een care sunt victime ale unei  agresiuni armate, nu \u015fi ca r\u0103spuns la violarea de c\u0103tre state a normelor  de drept interna\u0163ional \u00een alte forme, cum ar fi nerespectarea unor  obliga\u0163ii asumate prin tratate ori lezarea unor interese legitime.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; \u015fi  actual, simpla eventualitate a unui atac sau amenin\u0163area cu agresiunea  armat\u0103 neput\u00e2nd constitui un temei pentru ca recurgerea la for\u0163a armat\u0103  de c\u0103tre statul amenin\u0163at s\u0103 aib\u0103 caracterul de autoap\u0103rare legitim\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ac\u0163iunile militare preventive sunt contrare Cartei O.N.U. \u015fi dreptului interna\u0163ional contemporan.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Carta  O.N.U. nu cuprinde nici o men\u0163iune special\u0103 din care s\u0103 rezulte  deosebiri de principiu \u00eentre autoap\u0103rarea individual\u0103 \u015fi cea colectiv\u0103.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Autoap\u0103rarea  colectiv\u0103 presupune ca dou\u0103 sau mai multe state s\u0103-\u015fi acorde reciproc  sprijinul, inclusiv cu for\u0163ele lor armate, \u00een cazul \u00een care unul dintre  ele ar fi victim\u0103 a agresiunii. Pentru a da eficien\u0163\u0103 autoap\u0103r\u0103rii  colective, statele \u00eencheie de regul\u0103 \u00eenc\u0103 din timp de pace, \u00een baza art.  51 al Cartei O.N.U. , acorduri de asisten\u0163\u0103 mutual\u0103 prin care se  stabilesc condi\u0163iile \u015fi limitele furniz\u0103rii reciproce de sprijin militar  \u00een caz de agresiune. Un exemplu de asemenea acord \u00eel constituie  Tratatul Atlanticului&nbsp; de Nord, care st\u0103 la baza constituirii N..A.T.O..<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Potrivit  art. 51 al Cartei O.N.U. m\u0103surile luate de statele membre \u00een  exercitarea dreptului lor la autoap\u0103rare trebuie s\u0103 fie aduse imediat la  cuno\u015ftin\u0163a Consiliului de Securitate \u015fi nu trebuie s\u0103 afecteze \u00een nici  un fel puterea \u015fi \u00eendatoririle acestuia de a \u00eentreprinde oric\u00e2nd  ac\u0163iunile pe care le va socoti necesare pentru men\u0163inerea sau  restabilirea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n5<i>.&nbsp; Folosirea for\u0163ei de c\u0103tre popoarele coloniale \u015fi na\u0163iunile dependente pentru eliberarea lor na\u0163ional\u0103<\/i><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Organiza\u0163ia  Na\u0163iunilor Unite \u015fi-a propus printre scopurile sale \u015fi pe acela de a  dezvolta rela\u0163ii \u00eentre na\u0163iuni, \u00eentemeiate pe respectarea principiului  egalit\u0103\u0163ii \u00een drepturi&nbsp; a popoarelor \u015fi a dreptului lor de a dispune de ele \u00eensele.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dezvoltarea la scurt timp dup\u0103 adoptarea Cartei a unor ample mi\u015fc\u0103ri de eliberare colonial\u0103 \u015fi&nbsp; na\u0163ional\u0103,  pentru ob\u0163inerea independen\u0163ei, de c\u0103tre popoarele aservite \u00een variate  forme (colonii, mandate, tutel\u0103 interna\u0163ional\u0103, etc.) a dus la  pr\u0103bu\u015firea sistemului colonial \u015fi la formarea a circa 90 de state  independente, proces&nbsp; \u00een care lupt\u0103 popoarelor  respective a dob\u00e2ndit caracterul unei lupte legitime, iar opozi\u0163ia  fostelor state dominante caracterul unei ac\u0163iuni contrar\u0103 normelor \u015fi  principiilor dreptului interna\u0163ional.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Folosirea  for\u0163ei armate de c\u0103tre statele metropol\u0103 \u00eempotrive popoarelor aflate  sub domina\u0163ia lor, care \u00ee\u015fi caut\u0103 realizarea drepturilor lor legitime  inclusiv pe calea armelor, a c\u0103p\u0103tat astfel caracterul unei agresiuni  interna\u0163ionale.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Adunarea  General\u0103 a O.N.U. s-a pronun\u0163at \u00een acest sens \u00een numeroase documente  interna\u0163ionale, \u00een special \u00een cuprinsul Declara\u0163iei privind acordarea&nbsp; independen\u0163ei \u0163\u0103rilor&nbsp; \u015fi  popoarelor coloniale, din 1960, care proclam\u0103 incompatibilitatea dintre  regimul colonial \u015fi dreptul popoarelor de a-\u015fi hot\u0103r\u00e2 soarta, \u015fi  Rezolu\u0163ia din 1966 intitulat\u0103 \u201e Respectarea strict\u0103 a interdic\u0163iei  recurgerii la amenin\u0163area sau la folosirea for\u0163ei \u00een rela\u0163iile  interna\u0163ionale \u015fi a dreptului popoarelor la autodeterminare\u201d, \u00een care se  prevede expres c\u0103 orice ac\u0163iune care face apel la constr\u00e2ngere direct\u0103  sau indirect\u0103 pentru a lipsi popoarele supuse domina\u0163iei str\u0103ine de  dreptul lor la autodeterminare, la libertate \u015fi la independen\u0163\u0103,  constituie o violare a Cartei O.N.U.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cuprinsul Defini\u0163iei agresiunii din 1974 (art.7) se reafirm\u0103 dreptul popoarelor supuse unor regimuri coloniale&nbsp; sau rasiste ori altor forme de domina\u0163ie str\u0103in\u0103 de a lupta pentru eliberarea lor \u015fi de&nbsp; a  solicita \u015fi a ob\u0163ine ajutor din partea altor state pentru realizarea  acestui scop \u015fi, de\u015fi ac\u0163iunea acestor popoare nu figureaz\u0103 printre  actele de agresiune cuprinse \u00een art. 3, se men\u0163ioneaz\u0103 c\u0103 nimic din  defini\u0163ia dat\u0103 nu poate s\u0103 afecteze dreptul acestor popoare la lupta  lor.<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Protocolul I de la Geneva, din 1977, pentru reafirmarea \u015fi dezvoltarea dreptului&nbsp; interna\u0163ional  umanitar aplicabil \u00een perioada de conflict armat recunoa\u015fte din art. 1,  par. 4, ca av\u00e2nd caracter interna\u0163ional \u015fi \u201econflictele armate \u00een care  popoarele lupt\u0103 \u00eempotriva domina\u0163iei coloniale \u015fi a ocupa\u0163iei str\u0103ine \u015fi  \u00eempotriva regimurilor resiste, \u00een exercitarea dreptului popoarelor de a  dispune de ele \u00eensele&#8230;\u201d<\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ca atare, se poate conchide c\u0103 \u00een prezent&nbsp; recurgerea  la for\u0163a armat\u0103 pentru exercitarea dreptului popoarelor de a dispune de  ele \u00eensele constituie un caz special de legitim\u0103 ap\u0103rare, iar folosirea  for\u0163ei armate pentru a \u00eempiedica o asemenea lupt\u0103 este contrar\u0103 art. 2,  par.4, al Cartei, care prevede c\u0103 statele sunt obligate s\u0103 nu recurg\u0103  la amenin\u0163area cu for\u0163a sau la folosirea for\u0163ei nu numai \u00eempotriva  integrit\u0103\u0163ii teritoriale sau independen\u0163ei politice a oric\u0103rui stat, ci  \u015fi \u201e\u00een orice alt\u0103 manier\u0103 incompatibil\u0103 cu scopurile Na\u0163iunilor Unite\u201d.<\/div>\n<div style=\"margin-top: 0px;
