El este totodat\u0103 un subiect de drept  interna\u0163ional cu caracter universal, singurul care are capacitatea de  a-\u015fi asuma totalitatea drepturilor \u015fi obliga\u0163iilor cu caracter  interna\u0163ional. Conceptul de stat, a\u015fa cum rezult\u0103 din constitu\u0163iile  statelor implic\u0103 o colectivitate uman\u0103 instalat\u0103 cu caracter permanent  pe un anumit teritoriu \u015fi av\u00e2nd o structur\u0103 de organe ale puterii care  se bucur\u0103 de suveranitate.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  doctrina clasic\u0103 a dreptului interna\u0163ional se are \u00een vedere pentru a se  caracteriza o anumit\u0103 entitate ca stat, cu personalitate juridic\u0103  interna\u0163ional\u0103, ca acesta s\u0103 \u00eentrunesc\u0103 anumite elemente: popula\u0163ia,  teritoriul \u015fi existen\u0163a unui guvern independent.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aceste  elemente au fost cel mai bine precizate \u00een \u201eTratatul de la Montevideo\u201d  din 1933 \u00eencheiat \u00eentre S.U.A.\u015fi statele latino-americane cu privire la  drepturile \u015fi obliga\u0163iile statelor, \u00een care se stipula c\u0103 statul ca  subiect de drept interna\u0163ional trebuie s\u0103 \u00eentrunesc\u0103 urm\u0103toarele  condi\u0163ii:<a href=\"http:\/\/www.blogger.com\/post-create.do\" name=\"more\"><\/a><\/span><\/div>\n<p><\/p>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ultimul element implic\u0103 suveranitatea ca tr\u0103s\u0103tur\u0103 a puterii politice, ca atribut intrinsec al statului.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; a)  Popula\u0163ia reprezint\u0103 o comunitate uman\u0103 permanent\u0103 \u015fi organizat\u0103,  relativ numeroas\u0103 pentru a putea subzista prin resurse proprii \u015fi forma  ra\u0163iunea \u015fi substan\u0163a unui stat.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  ce prive\u015fte aspectul m\u0103rimii popula\u0163iei, nu exist\u0103 un criteriu anume,  dac\u0103 sunt \u00eentrunite celelalte caracteristici, de-a lungul istoriei \u015fi  ast\u0103zi exist\u00e2nd at\u00e2t state foarte mici (microstate sau state pitice), a  c\u0103ror popula\u0163ie variaz\u0103 de la c\u00e2teva zeci de mii de persoane (statele-  cet\u0103\u0163i antice, statele- ora\u015f \u00een Evul Mediu, statele foarte mici aflate  ast\u0103zi \u00een Europa \u2013 Monaco, San Marino, Andorra, Liechtenstein etc.),  p\u00e2n\u0103 la sute de milioane de locuitori sau, \u00een cazul Chinei, peste 1  miliard.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; b)  Teritoriul de stat delimiteaz\u0103 spa\u0163iul \u00een interiorul c\u0103ruia se exercit\u0103  suveranitatea unui anumit stat, at\u00e2t sub aspect intern, c\u00e2t \u015fi \u00een  raporturile cu alte state.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; Teritoriul  de stat are mai multe componente : solul, subsolul, apele interioare \u015fi  apele maritime interioare, marea teritorial\u0103, spa\u0163iul aerian de  deasupra cestora, mai pe scurt exprimat teritoriul poate fi terestru,  maritim \u015fi aerian.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; c)  Guvernul, ca element al existen\u0163ei unui stat, reprezint\u0103 totalitatea  structurilor institu\u0163ionale care exercit\u0103 prerogativele puterii asupra  ansamblului popula\u0163iei \u015fi teritoriului.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Formele  \u00een care se exercit\u0103 puterea, structura organelor de stat investite de  aceast\u0103 putere, ca \u015fi mijloacele \u015fi metodele de exercitare a puterii  difer\u0103 de la un stat la altul, important fiind ca exerci\u0163iul autorit\u0103\u0163ii  de stat s\u0103 fie exclusiv \u015fi efectiv.Exclusivitatea presupune ca statul  \u00een cauz\u0103 s\u0103-\u015fi exercite autoritatea singur, s\u0103 nu existe o alt\u0103  autoritate c\u0103reia s\u0103 i se supun\u0103 aceea\u015fi popula\u0163ie \u015fi acela\u015fi teritoriu,  iar efectivitatea implic\u0103 exercitarea \u00een mod real a puterii \u015fi nu doar  aparent sau nominal.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; d) Capacitatea de a intra \u00een rela\u0163ii cu alte state, ca element al existen\u0163ei unui stat, presupune, \u00eentre altele:<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -capacitatea de a \u00eencheia acte juridice interna\u0163ionale, de a fi parte la tratate sau alte instrumente juridice interna\u0163ionale;<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; -dreptul de a deveni membru \u015fi de a participa la activitatea organiza\u0163iilor interna\u0163ionale;<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -dreptul  de a utiliza mijloacele de reglementare pa\u015fnic\u0103 a diferendelor \u015fi de a  prezenta reclama\u0163ii \u00een fa\u0163a unor instan\u0163e interna\u0163ionale;<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -dreptul  de a-\u015fi asigura propria securitate, de a participa la sisteme  interna\u0163ionale de garantare a securit\u0103\u0163ii \u015fi de a recurge, \u00een condi\u0163iile  legii, la for\u0163\u0103, inclusiv la for\u0163a armat\u0103 \u00eempotriva unui act de  agresiune;<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; Preocup\u0103rile  \u00een aceast\u0103 privin\u0163\u0103 au ap\u0103rut \u00eenc\u0103 \u00een secolul al XVIII-lea, sub  influen\u0163a ideilor filozofiei iluministe.Primul doctrinar care s-a ocupat  \u00eendeaproape de aceast\u0103 problem\u0103 a fost Emeric de Vattel, care f\u0103cea o  distinc\u0163ie \u00eentre drepturile fundamentale ale omului, d\u0103ruite acestuia de  natur\u0103 \u015fi drepturile fundamentale ale statelor, care \u00ee\u015fi au fundamentul  \u00een dreptul natural.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  secolele al XIX-lea \u015fi al XX-lea, teoria drepturilor fundamentale ale  statelor a cunoscut o puternic\u0103 dezvoltare doctrinar\u0103, ea g\u0103sisdu-\u015fi o  prim\u0103 transpunere \u00een planul reglement\u0103rii \u00een men\u0163ionata \u201eConven\u0163ie de la  Montevideo\u201d din 1933, apoi \u00een \u201eCarta de la Bogota\u201d, actul constitutiv  al O.S.A., \u00een care a fost inclus\u0103 \u015fi o \u201eDeclara\u0163ie a drepturilor \u015fi  obliga\u0163iilor fundamentale ale statelor\u201d.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; La  tratativele pentru constituirea O.N.U., s-a f\u0103cut propunerea ca o  asemenea declara\u0163ie s\u0103 figureze \u00een Cart\u0103, \u00eens\u0103 nu s-a acceptat, dar la  scurt timp dup\u0103 constituirea Comisiei de drept interna\u0163ional a Adun\u0103rii  generale a organiza\u0163iei aceasta a fost \u00eens\u0103rcinat\u0103 cu elaborarea  proiactului unei Declara\u0163ii a drepturilor \u015fi obliga\u0163iilor statelor, care  p\u00e2n\u0103 \u00een prezent nu a fost finalizat.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen  cadrul O.N.U. au fost adoptate \u201eCarta drepturilor \u015fi \u00eendatoririlor  economice ale statelor\u201d (1974), precum \u015fi numeroase declara\u0163ii \u00een care  se formuleaz\u0103 drepturi \u015fi obliga\u0163ii fundamentale ale statelor, \u00eentre  care sunt de men\u0163ionat cele privitoare la acordarea independen\u0163ei  \u0163\u0103rilor \u015fi popoarelor coloniale (1960), principiile dreptului  interna\u0163ional privind rela\u0163iile prietene\u015fti \u015fi cooperarea \u00eentre state  (1970), \u00eent\u0103rirea securit\u0103\u0163ii interna\u0163ionale (1970)etc.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De\u015fi  p\u00e2n\u0103 \u00een prezent nu s-a ajuns \u00eenc\u0103 la un acord deplin asupra unor  criterii unitare pentru stabilirea unei clasific\u0103ri generale \u015fi uniforme  a drepturilor \u015fi \u00eendatoririlor fundamentale, \u00een documentele amintite \u015fi  \u00een literatura juridic\u0103 sunt consacrate o sum\u0103 de asemenea drepturi \u015fi  \u00eendatoriri.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Drepturile  fundamentale ale statelor sunt: dreptul la existen\u0163\u0103; dreptul la  suveranitate \u015fi independen\u0163\u0103; dreptul de a dispune asupra propriilor  destine; dreptul la pace \u015fi securitate; dreptul la integrarea  teritoriului \u015fi la inviolabilitatea frontierelor; dreptul la  autoap\u0103rare; dreptul asupra resurselor naturale; dreptul la egalitate  suveran\u0103; dreptul de a participa la rezolvarea problemelor  interna\u0163ionale;dreptul la cooperare;dreptul de a face comer\u0163, dreptul de  acces la cuceririle \u015ftiin\u0163ei \u015fi tehnicii;dreptul de a face parte din  organiza\u0163iile interna\u0163ionale;dreptul de a participa la tratatele  interna\u0163ionale;dreptul la un tratament nediscriminatoriu.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: 150%; nerecurgerea la for\u0163\u0103 sau la amenin\u0163area cu for\u0163a; rezolvarea  pe cale pa\u015fnic\u0103 a diferendelor lor, \u00eendeplinirea cu bun\u0103 credin\u0163\u0103 a  tratatelor \u015fi a tuturor obliga\u0163iilor asumate;
