Dl. Marin Ioan, domiciliat in Iasi , str.Florilor<span>&nbsp; <\/span>nr.6 , bloc V3, scara A, etaj 9, apartament 54, judetul Iasi , nascut la data de 14 februarie 1957 in Iasi, judetul Iasi, fiul lui Ioan si al Ioanei, posesorul cartii de identitate seria GT nr.546893 eliberata de Politia Municipiului Iasi , cod numeric personal 1195702140762,<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\"><span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>au convenit sa incheie prezentul contract de vanzare-cumparare cu respectarea urmatoarelor clauze:<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">II. OBIECTUL CONTRACTULUI<\/span><\/b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\"><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">2.1.Vanzatorul , in calitate de proprietar al averii defunctului Ionescu Ioan, <span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span>prin certificatul de mostenitor nr. 1345 eliberat de notarul public \u201eX.Y.\u201d din Iasi <span>&nbsp;<\/span>vinde intreaga mostenire cuprinzand atat active cat si pasive , cumparatorului care se obliga a plati un pret.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">III. PRETUL SI MODALITATEA DE PLATA<\/span><\/b><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">3.1.Pretul pe care cumparatorul este obligat sa-l achite vanzatorului este de 25.000.000.000 lei.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">3.2. Plata se va efectua in momentul transmiterii proprietatii asupra tuturor bunurilor mobile si imobile ce reprezinta mostenirea vanduta.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">IV. OBLIGATIILE VANZATORULUI<\/span><\/b><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">4.1. Sa predea cumparatorului toate bunurile mobile si imobile ale mostenirii.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">4.2. Sa predea cumparatorului fructele percepute , creantele incasate sau pretul lucrurilor vandute din masa succesorala.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">4.3. Sa suporte cheltuielile predarii masei succesorale.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">V. OBLIGATIILE<span>&nbsp; <\/span>CUMPARATORULUI <\/span><\/b><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">5.1. Sa restituie vanzatorului sumele platite de acesta pentru datoriile si sarcinile mostenirii.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">5.2. Sa plateasca pretul in conditiile aratate in prezentul contract.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">5.3. Sa suporte cheltuielile aferente autentificarii prezentului inscris si a inscrierii dreptului de proprietate in cartea funciara.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">VI. RASPUNDEREA<span>&nbsp; <\/span>CONTRACTUALA<\/span><\/b><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">6.1. Vanzatorul nu raspunde pentru neexecutarea contractului in caz de forta majora notificata cumparatorului in termen de 5 zile de la aparitia ei si constata in termen de 15 zile de la notificare.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">6.2. In conditiile alineatului precedent , contractul se reziliaza fara a se putea pretinde daune interese.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">6.3. Cumparatorul este de drept in intarziere pentru neexecutarea obligatiei<span>&nbsp; <\/span>de plata a pretului si datoreaza daune moratorii in conditiile clauzei penale.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">VII. CLAUZA<span>&nbsp; <\/span>PENALA<\/span><\/b><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">7.1. Partile se obliga reciproc la executarea intocmai si la timp a obligatiilor contractuale.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">7.2. Pentru neexecutare in totalitate sau in parte , ori pentru executarea necorespunzatoare a obligatiilor prevazute in contract , partile datoreaza daune interese in conditiile prezentei clauze penale : <\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">a) in sarcina vanzatorului . Pentru intarzierea in predarea bunurilor vanzatorul datoreaza cumparatorului daune-moratorii in valoare de 0.03\/% in primele zile de intarziere, 0.50% in urmatoarele 20 de zile, si 0.75% pentru perioada ce depaseste 30 de zile , dar nu mai mult de 90 de zile, calculate la pretul produselor respective.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">b)<span>&nbsp;&nbsp; <\/span>in sarcina cumparatorului . Pentru fiecare zi de intarziere in plata pretului , cumparatorul datoreaza vanzatorului daune moratorii in valoare de 0.50% in urmatoarele 20 de zile si 0.75% in urmatoarele 60 de zile, fara a depasi 90 de zile , din valoare produselor neachitate.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">VIII. <\/span><\/b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">Prezentul contract constituie singurul instrument juridic probant pentru solutionarea eventualelor litigii intre parti pe cale amiabila ori, in caz de neintelegere , prin actiune in justitie in daune interese adresata instantei competente.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">IX. <\/span><\/b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\">Contractul a fost \u00eencheiat \u00een 2 (doua) exemplare , cate unul pentru fiecare parte.<\/span><\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\">\n<\/div>\n<div class=\"MsoNormal\" style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 11pt;\"><span>&nbsp;<\/span>VANZATOR , _______________________<span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>CUMPARATOR, ________________________<\/span><\/div>\n<div align=\"center\" class=\"MsoNormal\" style=\"margin-left: 67.5pt; text-align: center;\">\n<\/div>\n<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div>","protected":false},"excerpt":{"rendered":"<p>Incheiat astazi 9 noiembrie 2003 la Notariatul Public \u201eX.Y.\u201d I.
